Terms of Service

Effective: 1 June 2025 Last updated: 1 June 2025 Governing law: India
Please read these Terms of Service ("Terms") carefully before registering for or using any Meduvita product or service. By creating an account, making a purchase, or accessing the platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services. These Terms form a legally binding agreement between you and Meduvita.

1 About Meduvita

Meduvita is a UCAT (University Clinical Aptitude Test) preparation platform primarily serving students applying to UK medical schools. We operate two connected products:

Meduvita Q-Bank

An AI-powered online question bank accessible at meduvita.com. The Q-Bank provides adaptive practice questions across all four UCAT sections — Verbal Reasoning (VR), Decision Making (DM), Quantitative Reasoning (QR), and Situational Judgement (SJ) — together with full 2-hour timed mock exams, real-time AI-powered explanations, a persistent AI tutor, UCATSEN mode for students with extended time allowances, and detailed performance analytics.

Meduvita.com (Live Courses)

A live teaching service offering small-group UCAT instruction capped at 15 students per cohort, delivered by experienced medical students, providing 60+ hours of structured instruction. Live courses are purchased separately.

Together these products form an integrated UCAT preparation ecosystem. These Terms govern your use of both unless separate terms are presented at the point of purchase.

2 Acceptance of Terms

By accessing or using any Meduvita service — including creating an account, completing a purchase, attending a live session, or using any Q-Bank feature — you represent and warrant that:

  • You have read, understood, and agree to these Terms in their entirety;
  • You have read and agree to our Privacy Policy;
  • You have the legal capacity to enter into a binding contract under applicable law;
  • All information you provide to us is accurate, current, and complete.

If you are accepting these Terms on behalf of a minor, you represent that you are the minor's parent or legal guardian and accept these Terms on their behalf, accepting personal responsibility for their use of the platform. Your continued use of the platform following any update to these Terms constitutes ongoing acceptance of the updated Terms.

3 Eligibility

To use Meduvita, you must:

  • Be at least 13 years of age. Users between 13 and 18 require verifiable parental or guardian consent;
  • Be a student preparing for the UCAT or a parent/guardian acting on behalf of such a student;
  • Have the legal capacity to enter into binding contracts under the laws of your country of residence. Under the Indian Contract Act 1872, you must be at least 18 years old to enter into a contract in your own right — users under 18 must have a parent or guardian accept these Terms on their behalf;
  • Not be subject to any sanctions or legal prohibitions that would prevent you from entering this agreement;
  • Not have been previously suspended or terminated from Meduvita for breach of these Terms.

We reserve the right to request proof of eligibility at any time and to refuse or revoke access where eligibility cannot be confirmed.

4 Your Account

Registration

You must create an account to access the Q-Bank. You agree to provide accurate, complete, and current information during registration and to keep your account information up to date. Providing false or misleading information is a breach of these Terms and may result in immediate termination.

Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must:

  • Choose a strong, unique password and not reuse passwords from other services;
  • Never share your credentials with any other person;
  • Log out after each session on shared or public devices;
  • Notify us immediately at support@meduvita.com if you suspect any unauthorised access.

Meduvita will not be liable for any loss or damage arising from your failure to protect your credentials.

One Account per Person

Each subscription is strictly for one named individual. Creating multiple accounts to circumvent pricing or gain additional access is prohibited and will result in termination of all associated accounts without refund.

Account Accuracy

You must keep your registered email address current. Meduvita will send important notices to your registered email. You are responsible for any failure to receive communications due to an outdated email address.

Google Sign-On

If you register via Google OAuth, your Meduvita account security is also dependent on your Google account security. We recommend enabling two-factor authentication on your Google account.

Live course bookings are subject to availability. We reserve the right to adjust schedules with reasonable notice, substitute tutors where necessary, or cancel a cohort with insufficient enrolment, in which case a full refund will be issued.

Discount for Course Students

Students enrolled in a Meduvita live course are entitled to a discount on the Q-Bank. This discount is personal to the enrolled student, non-transferable, non-combinable with other offers, and subject to enrolment verification. Meduvita reserves the right to revoke the discount if misuse is detected.

Service Availability

We aim for 24/7 availability but do not guarantee uninterrupted access. The platform may be temporarily unavailable due to scheduled maintenance, emergency maintenance, or circumstances beyond our control (see Section 16). We will provide advance notice of scheduled downtime where practicable.

We may add, modify, or remove features at any time. We will provide reasonable notice for changes that materially reduce the core functionality you subscribed for. Minor enhancements or UI changes do not require advance notice.

Beta Features

We may offer beta or early-access features on an "as is" basis without warranty. Beta features may be withdrawn at any time, and use is at your own risk.

Your Licence

You may not copy, distribute, create derivative works, use any Meduvita trademark without prior written consent, or frame any part of the platform on another website.

Your Feedback

Any feedback, suggestions, or ideas you submit grant us a perpetual, irrevocable, royalty-free, worldwide licence to use and commercialise them without obligation or compensation to you.

UCAT Trade Mark Notice

"UCAT" and "UCATSEN" are used solely as descriptive terms to identify the exam our platform helps students prepare for. Meduvita is not affiliated with, endorsed by, or officially connected to the UCAT Consortium, Pearson VUE, or any university admissions body. Our questions are independently created and are not official UCAT past papers.

Copyright Notices

If you believe any content infringes your intellectual property rights, send a written notice to support@meduvita.com identifying the work, the allegedly infringing material, your contact details, and a statement of good-faith belief.

10 AI Features & Limitations

The Q-Bank uses artificial intelligence for explanations, adaptive difficulty, performance analysis, the AI tutor, and post-exam debriefs. You acknowledge that:

  • AI-generated content is produced automatically and may occasionally contain errors or imprecisions;
  • AI explanations are educational guidance only and do not constitute professional advice of any kind;
  • The adaptive algorithm is designed to optimise question selection based on your performance data but does not guarantee any specific score or outcome;
  • AI behaviour may change as we update or retrain models;
  • You should exercise independent judgement when evaluating AI feedback and cross-reference with authoritative UCAT preparation resources;
  • Anonymised, aggregated performance data may be used to improve our AI models (see our Privacy Policy).
No AI Guarantee: Meduvita does not warrant that AI explanations are error-free or that the adaptive algorithm will optimise preparation for your specific circumstances. The AI tutor is a supplementary learning tool, not a replacement for independent study and critical thinking.

11 Third-Party Services & Links

The platform integrates with third-party services including payment processors, Google authentication, and analytics tools. Your use of those services is governed by their own terms and privacy policies. Meduvita does not endorse or take responsibility for third-party content, terms, or practices, and is not liable for loss or damage arising from your use of or reliance on third-party services linked to the platform.

12 Disclaimers

To the fullest extent permitted under applicable law, Meduvita provides the platform and all content on an "as is" and "as available" basis, without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, uninterrupted access, or freedom from viruses.

No Score or Admission Guarantee: Meduvita makes no guarantee that use of the Q-Bank or attendance at live courses will result in any particular UCAT score, university interview, conditional offer, or medical school admission. Results depend on many individual factors outside our control.

Meduvita is not affiliated with, endorsed by, or officially connected to the UCAT Consortium, Pearson VUE, any UK university, or any medical school admissions body. Any information on scoring ranges, university cut-offs, or selection processes is provided for general guidance only and should always be verified directly with the relevant institution or official UCAT resources.

13 Limitation of Liability

To the maximum extent permitted by applicable law:

  • Meduvita's total aggregate liability for all claims shall not exceed the subscription fees paid by you in the 12 months preceding the event giving rise to the claim;
  • Meduvita shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, opportunity, or goodwill;
  • We shall not be liable for loss resulting from: reliance on AI-generated content; failure to meet UCAT score thresholds; university application decisions; or third-party service failures.

Nothing in these Terms excludes liability for death or personal injury caused by our gross negligence or wilful misconduct, or for fraud, or for any other liability that cannot be lawfully excluded under applicable Indian consumer protection law including the Consumer Protection Act 2019.

14 Indemnification

You agree to defend, indemnify, and hold harmless Meduvita, its officers, employees, agents, and licensors from and against any claims, damages, losses, costs, and reasonable legal fees arising out of or relating to:

  • Your use of the platform in violation of these Terms;
  • Your violation of any applicable law or regulation;
  • Your infringement of any third-party intellectual property or other rights;
  • Any content you submit through the platform;
  • Your sharing of login credentials or account access with another person.

15 Suspension & Termination

By You

You may terminate your account at any time by cancelling your subscription and requesting account deletion via support@meduvita.com. Deletion requests are processed within 30 days, subject to applicable data retention obligations.

By Meduvita

We may suspend or terminate your account immediately and without notice if you breach these Terms, we suspect fraud or misuse, we are required to do so by applicable law, or payment repeatedly fails. We may terminate with 30 days' notice (and pro-rata refund for unused subscription time) if we discontinue the platform.

Effect of Termination

Upon termination, your licence ceases immediately and you lose access to all content and data. Sections 9, 12, 13, 14, 17, 18, and 19 survive termination.

16 Force Majeure

Meduvita shall not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including: acts of God; war, terrorism, or civil unrest; pandemic or public health emergency; internet or infrastructure failures; cyberattacks by third parties; failure of third-party service providers; or changes in applicable law. We will notify you as soon as practicable of any such event and use reasonable endeavours to resume normal service promptly.

17 Dispute Resolution

Informal Resolution

Before initiating formal proceedings, you agree to contact us at support@meduvita.com and give us at least 30 days to resolve the dispute informally.

Mediation

If informal resolution fails, the parties agree to attempt resolution through good-faith mediation before resorting to arbitration or litigation.

Arbitration

If mediation fails within 60 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act 1996 (India). The arbitration shall be conducted in English. The arbitrator's award shall be final and binding.

Exceptions

Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm, including protection of intellectual property rights, pending arbitration.

Consumer Rights

Nothing in this Section limits any statutory rights you may have as a consumer under the laws of your country of residence that cannot be contractually excluded, including rights under the UK Consumer Rights Act 2015 or the Indian Consumer Protection Act 2019.

18 Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act 1872, the Information Technology Act 2000 (as amended), the Consumer Protection Act 2019, the Copyright Act 1957, and the Trade Marks Act 1999.

Subject to the arbitration agreement in Section 17, the courts of India shall have jurisdiction over any disputes not resolved by arbitration.

Note for UK and international users: While these Terms are governed by Indian law, we acknowledge that consumers in the United Kingdom and other jurisdictions may have statutory rights under local law (such as the UK Consumer Rights Act 2015) that cannot be excluded by contract. Nothing in these Terms is intended to deprive you of those mandatory statutory protections.

19 General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any order confirmations or supplemental terms at purchase, constitute the entire agreement between you and Meduvita and supersede all prior agreements and understandings.

Severability

If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary or severed. Remaining provisions continue in full force.

Waiver

No failure or delay in exercising any right constitutes a waiver. A waiver of any breach does not constitute a waiver of any subsequent breach.

Assignment

You may not assign your rights or obligations without our prior written consent. Meduvita may assign these Terms in connection with a merger, acquisition, or asset sale, provided the assignee is bound by these Terms.

Notices

Notices from Meduvita are sent to your registered email and are deemed received upon sending. Notices to Meduvita must be sent to support@meduvita.com and are deemed received upon our acknowledgement.

No Agency

Nothing in these Terms creates any partnership, joint venture, employment, franchise, or agency relationship.

Language

These Terms are written in English. In any conflict between the English version and a translation, the English version prevails.

20 Changes to These Terms

We may update these Terms to reflect changes in our services, applicable law, or business practices. For material changes, we will notify you by email at least 14 days before they take effect and display a prominent notice on the platform. Continued use after the effective date constitutes acceptance. If you do not agree, you must cancel your subscription before the effective date.
